Terms and conditions of sale

Article 1 — Purpose and scope
These terms and conditions of sale ("T&Cs") govern all sales concluded on the PMW Iconic Trends Wear website between PMW ICONIC TRENDS WEAR, a company registered in the United Arab Emirates under trade licence no. 45031675, registered office Al Seba Street, Dubai (hereinafter "the Seller", "we"), and any natural person acting for non-professional purposes (hereinafter "the Customer", "you").

Placing an order implies full and unreserved acceptance of these T&Cs, in the version in force on the day of the order. We invite you to read them before confirming your basket and to keep a copy.
Article 2 — Products
We sell personalized mugs and accessories, decorated using high-definition sublimation.
The essential characteristics of each product (material, capacity, dimensions, care) are stated on its product page. Photographs are illustrative and non-contractual: slight variations in shade or in the positioning of the design may appear, without constituting a lack of conformity.
Our offers are valid for as long as they are visible on the site and while stocks last. If an item becomes unavailable after your order is confirmed, you will be informed without delay and refunded in full within 14 days at the latest.
Article 3 — Prices
Prices are shown in euros (EUR), inclusive of all taxes where applicable, excluding shipping costs.
The total amount payable — price of the items, shipping costs and applicable taxes — is summarised for you on the payment page before you finally confirm your order.
We reserve the right to change our prices at any time. Products are invoiced on the basis of the rate in force when the order is recorded.
Article 4 — Placing an order
The ordering process takes place in four steps:
- selecting items and adding them to the basket;
- entering your details and the delivery address;
- checking the full summary (items, quantities, prices, shipping costs, total) and correcting any input errors;
- confirming payment, which concludes the contract.
A confirmation e-mail setting out the details of the order is sent to you after validation. We recommend that you keep it.
We reserve the right to refuse or cancel any order on legitimate grounds, in particular in the event of a previous payment dispute, an abnormal order or suspected fraud.
Article 5 — Payment
Payment is made online, in full, at the time of the order, using the methods offered on the payment page (bank cards and electronic wallets, subject to availability).
Transactions are secured by our payment provider. Your bank details are transmitted in encrypted form and are never stored on our servers.
The order is only processed once payment has actually been received.
Article 6 — Delivery
Orders are prepared and shipped from France. Delivery areas, rates and times are detailed in our Shipping policy, which forms an integral part of these T&Cs.
In accordance with Article L216-1 of the French Consumer Code, we undertake to deliver no later than 30 days after the contract is concluded. Failing that, you may require us to deliver within a reasonable additional period and then, if that also fails, terminate the contract by registered letter or in writing on a durable medium. Any sums paid are then refunded to you within 14 days at the latest.
The risk of loss or damage passes to the Customer when the parcel is physically taken into possession.
Article 7 — Right of withdrawal
You have 14 days from receipt of your order to exercise your right of withdrawal, without having to give a reason.
Important exception: in accordance with Article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to your specifications or clearly personalized at your request (artwork, text, first name or photograph supplied by you). Catalogue items, offered as they are without any input from you on the design, remain fully eligible for withdrawal.

Article 8 — Legal guarantees
Independently of any commercial warranty, you benefit from the following legal guarantees, free of charge:
- Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): you have 2 years from delivery of the goods to bring a claim. You may choose between repair and replacement, subject to the cost conditions provided for in Article L217-12. You are not required to prove the existence of the lack of conformity during the 24 months following delivery.
- Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): you may bring a claim within 2 years of discovering the defect and obtain rescission of the sale or a reduction in price.

These guarantees do not cover normal wear and tear, nor damage resulting from use that does not follow the care recommendations (impacts, microwaving where the design is metallic, abrasive cleaning).
Article 9 — Liability
We cannot be held liable for non-performance attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure.
Nothing in these T&Cs has the effect of excluding or limiting the rights that the law grants to consumers on a mandatory basis.
Article 10 — Intellectual property
The visuals, designs and content of the site are protected. Their reproduction or exploitation without authorisation is prohibited. See our Legal notice.
When you send us artwork or text for personalization, you warrant that you hold the necessary rights to use it and you indemnify us against any third-party claim. We reserve the right to refuse any content that is unlawful, infringing, defamatory or contrary to public decency.
Article 11 — Personal data
The data collected is necessary to process your order. Its processing, together with your rights of access, rectification, erasure, portability and objection, is described in our Privacy policy.
Article 12 — Complaints and dispute resolution
If you encounter a problem, contact us first at pmw.iconictrendswear@gmail.com: we undertake to seek an amicable solution within 48 business hours.
Failing an amicable agreement, any dispute relating to the formation, interpretation or performance of these T&Cs may be brought before the competent courts under the conditions set out in Article 13.
Article 13 — Governing law
These T&Cs are governed by the law of the United Arab Emirates.
However, in accordance with Regulation (EC) No 593/2008 known as "Rome I", this choice cannot deprive a consumer residing in the European Union of the protection afforded by the mandatory provisions of the law of their country of habitual residence. The consumer retains the right to bring proceedings before the courts of their place of domicile.
